Can I clone only the actively used part of a 320g HD?

I have a 320g HD in my late 2008 Macbook Pro with 205g of it free. I want to add a SSD to the system and use the HD as a data drive. Can I use a smaller - say 160g SSD and clone the HD to the smaller SSD? I know you are supposed ot use the same size SSD as the HD but is that true even if you aren't using the entire HD? Thank you.

Cloning - no'' (when "cloning" your Mac Hard Drive, you are essentially creating a exact copy or backup of your entire Mac system, this includes Operating System files and the Users home directories).''- copying -yes

Why not use the restore function of Mac's Disk Utility to restore from your old HD backup to your new SSD, of you'll are able to mount all disks somehow (externally or internally) OR instal the OS on the SSD and use MigrationAssistant transfer just the files from your old account you'll want there.
